Top-hat plan

A nonqualified deferred compensation plan set up for a select group of executives and/or highly paid employees. The Department of Labor has stated that there is no compensation threshold for determining qualification for a top-hat plan. The phrase can be a generic term for most NQDC plans set up to fit into the ERISA top-hat exemption.
