This applies to compensation on which FICA taxes (Social Security and Medicare) have already been paid at the time of deferral. Once compensation is part of wages for FICA, any further earnings or gains are not considered FICA wages. The rule ensures that this compensation is not subjected to FICA taxes again at distribution, assuming the crediting rate used fits certain guidelines.
